Welcome to VoiceMind. These Terms & Conditions ("Terms") govern your use of the VoiceMind mobile application, website, and related services (collectively, the "App"). By downloading, installing, accessing, or using the App you accept and agree to be bound by these Terms. If you do not agree to all of these Terms, do not use the App and immediately uninstall it.

1. Definitions

  • "VoiceMind," "we," "us," "our" means VoiceMind (and its affiliates, owners, employees, contractors and partners).
  • "You," "your," "User" means any person who downloads, accesses, or uses the App.
  • "Content" means all text, audio, images, prompts, tools, journaling features, assessments, and other materials provided in the App.

2. Acceptance of Terms & Eligibility

By using the App you represent that you are at least the minimum age required by applicable law to form a binding contract in your jurisdiction or that you have parental/guardian consent. If you are using the App on behalf of an organization, you represent you have authority to bind that organization to these Terms.

3. Nature of the App — SELF-REFLECTION ONLY / NO DIAGNOSIS

3.1 No Medical/Professional Advice. VoiceMind provides wellness, mindfulness, journaling and self-reflection content for informational and personal self-reflection purposes only. The App does NOT provide medical, psychological, psychiatric, therapeutic, diagnostic, counselling, or other professional health services. Nothing in the App constitutes medical advice, treatment, diagnosis, or professional guidance.

3.2 No Diagnosis / No Clinical Assessment. The App does not diagnose, assess, evaluate, detect symptoms, interpret mental states, offer treatment plans, provide therapeutic interventions, monitor mental health conditions, predict risks, or give personalized professional advice. All insights, prompts, recommendations or outputs are non-clinical, subjective, and for self-reflection only.

3.3 No Reliance for Clinical Decisions. You acknowledge that you will not rely on the App for clinical decisions. Always consult a qualified health professional for medical or mental health concerns.

4. Emergency & Crisis Disclaimer

Important Warning:

VoiceMind is not a crisis or emergency service and cannot detect emergencies. If you are in immediate danger, experiencing suicidal thoughts, self-harm, or a medical emergency, contact local emergency services, a crisis hotline, or a licensed healthcare provider immediately. Do not use VoiceMind as a substitute for emergency services.

5. Use at Your Own Risk; Assumption of Risk

Your use of the App and Content is entirely at your own risk. You are responsible for any outcomes, decisions, or actions you take after using the App. You understand and accept that Content may be inaccurate, incomplete, subjective, or unsuitable for your needs.

6. No Warranties; AS IS / AS AVAILABLE

THE APP AND ALL CONTENT ARE PROVIDED "AS IS," "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, OR CONTINUOUS AVAILABILITY. We do not warrant the App will be error-free, secure, or meet your requirements.

7. Limitation of Liability — Maximum Extent Permitted by Law

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VOICEMIND, ITS AFFILIATES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).

Where liability cannot be excluded by law, our aggregate liability for any claim arising out of or in connection with these Terms shall be limited to the greater of (a) the amount you actually paid to VoiceMind in the preceding 12 months, or (b) an amount required by applicable law.

8. Indemnification

You agree to indemnify, defend and hold harmless VoiceMind and its officers, directors, employees, agents, affiliates and partners from and against any claims, demands, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the App; (b) your breach of these Terms; (c) your violation of any law or the rights of a third party; or (d) any content you submit to the App.

9. User Conduct & Community Rules

You agree not to:

  • use the App for unlawful or harmful purposes;
  • harass, stalk, threaten, abuse or harm other users;
  • upload, post or transmit content that is unlawful, hateful, harassing, pornographic, violent, or otherwise objectionable;
  • attempt to reverse-engineer, decompile, interfere with, or damage the App;
  • access another person's account without permission; or
  • use the App to collect or store personal data about others without their consent.

We may monitor content in community features and may remove content, suspend or terminate accounts for any violation of these Terms or to protect other users. We are not required to police content but may do so in our sole discretion.

10. Content, User Submissions & Intellectual Property

10.1 Our Content. All rights, title and interest in VoiceMind Content (including text, audio, images, designs, code, trademarks and logos) remain our exclusive property or our licensors'. You may only use Content as expressly authorized in writing.

10.2 Your Submissions. If you submit or upload content (e.g., journaling entries, audio, or forum posts), you grant VoiceMind a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, create derivative works, communicate, publish and distribute that content for the purpose of operating, providing, improving and promoting the App. You represent you have the rights and permissions to submit such content and that submitting it does not violate any privacy, publicity, or other rights.

10.3 Intellectual Property Protections. You will not remove, obscure or alter any proprietary notices (copyright, trademarks) on any Content.

11. Privacy & Data Handling (Summary)

11.1 Collection. We may collect account information, device and technical data, usage analytics, and optional content you choose to enter (e.g., journal entries).

11.2 Use. Data is used to provide, personalize and improve the App, to communicate with you, and for security and analytics. We do not sell your personal data.

11.3 Sharing. We may share data with service providers who perform services for us, affiliates, or as required by law. We may share aggregated, anonymized data for research or business purposes.

11.4 Security & Risk. We implement reasonable security measures, but no system is fully secure. You accept inherent risks in data transmission and storage. We are not liable for unauthorized access except as required by applicable law.

11.5 Your Rights. Depending on your jurisdiction, you may have rights to access, correct, delete or restrict processing of personal data. For details, see our full Privacy Policy available at: /privacy.

11.6 Retention & International Transfer. We retain data as described in our Privacy Policy. Data may be processed or stored outside your jurisdiction; by using the App you consent to cross-border transfers consistent with our Privacy Policy.

12. Children & Minors

The App is not intended for children below the age of 13 (or higher minimum age required by local law). If you are a parent or guardian and become aware that your child has provided us with personal information without consent, contact us to request its deletion.

13. Third-Party Services & Links

The App may contain links to third-party websites, services or resources. We do not endorse or control third-party content and are not responsible for any loss or damage arising from your use of third-party services. Your relationship with third parties is solely between you and that third party.

14. Payments & Subscription Terms

VoiceMind offers one monthly subscription of $7.77.

By subscribing, you agree that:

  • Your subscription automatically renews every month, until you cancel it.
  • You will be charged monthly whether or not you use the App.
  • All payments are final and non-refundable.
  • The subscription only stops when you cancel it through your device's App Store/Google Play settings.
  • Refunds are only provided if required by law or if issued by the App Store/Google Play under their own policies.

15. Termination & Suspension

We may suspend or terminate your access to the App, or remove Content, at any time and for any reason, including suspected breach of these Terms, without liability to you. Upon termination you must stop using the App and delete any copies. Sections that by their nature survive termination (including intellectual property, indemnity, limitation of liability, and governing law) will continue in full force and effect.

16. Governing Law; Jurisdiction

These Terms are governed by the laws of South Africa. To the maximum extent permitted by law, you agree that the courts of South Africa have exclusive jurisdiction to resolve any dispute arising from or relating to these Terms.

17. Changes to These Terms

We may update these Terms at any time. When we do, we will post the revised Terms in the App or on our website and update the "Effective Date." Continued use of the App after changes are posted constitutes acceptance of the updated Terms. It is your responsibility to review Terms periodically.

18. Severability; Waiver; Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision will be struck and the remaining provisions will remain in force. Failure to enforce any provision is not a waiver. These Terms (together with the Privacy Policy and any in-App policies) constitute the entire agreement between you and VoiceMind regarding the App.

20. Acknowledgement & Consent

By using the App you acknowledge that you have read, understood and agree to be bound by these Terms. You acknowledge that you have read the disclaimers regarding medical advice, diagnosis and emergencies, and that you assume any risks associated with using the App.
